Terms & Liability – New England Covered Bridges & Fall Colors
The agreement below governs the New England Covered Bridges & Fall Colors Photography Workshop [hereafter referred to as Workshop] activities conducted by Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities.
By signing your name on this form you hereby release Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities from liability and assume the risks as follows: This liability release is for any and all liability for personal injuries including death and property losses or damage in connection with any activity or accommodation of the above mentioned Barry Spruce Photography, LLC.
1. On rare occasions accidents or death may occur from participation in outdoor adventures, which necessitates the administration of medical care, hospitalization or surgery. Therefore, you give Barry Spruce Photography, LLC authorized representative(s) or agent(s) in charge of the aforesaid Workshop authorization to secure necessary treatment and transportation. Such treatment and transportation shall be solely at your expense and you agree to reimburse Barry Spruce Photography, LLC any expenses which it may incur from said injury treatment and transportation.
2. You understand and agree to indemnify and hold harmless Barry Spruce Photography, LLC and its representative(s) and agent(s) from any and all claims and causes of action for damage arising out of any travel or activity conducted by or under the control of Barry Spruce Photography, LLC with regard to the aforesaid Workshop.
3. You further understand that you are solely responsible for any and all costs arising out of your voluntary or involuntary withdrawal from the aforesaid Workshop prior to its completion, including withdrawal caused by illness. Trip/travel insurance is recommended. Each attendee is responsible for all additional costs including, but not limited to, travel, lodging, and transportation before and after the Workshop; meals not included in the Workshop; other incidentals; travel/trip insurance. Workshop payments are non-refundable. No refund will be issued if you withdraw from the Workshop. Trip/travel insurance is recommended. Barry Spruce Photography, LLC is not responsible for cancellations or Workshop schedule changes due to events outside of Barry Spruce Photography, LLC’s control such as local, State, Federal or other governing body shutdowns, travel restrictions/bans, civil unrest, labor disturbances, natural disasters, etc. Refunds will not be issued should such events occur; however, we will work with Workshop participants to reschedule to a new date or provide full credit to join another Workshop. Barry Spruce Photography, LLC is not responsible for reimbursement of any travel expenses or other related expenses in the event of Workshop cancellation or rescheduling. In the unlikely event that Barry Spruce Photography, LLC cancels the Workshop for reasons within Barry Spruce Photography, LLC’s control and does not reschedule it, a full refund of the Workshop fee/deposit will be given. Barry Spruce Photography, LLC reserves the right to cancel the Workshop in the event that there are not enough participants registered.
4. Workshop participants grant Barry Spruce Photography, LLC its agents, employees, licensees, and successors in interest (collectively, the “Released Party”) rights and permission to copyright, use and publish the participant’s photographed likeness obtained during participation in the Workshop. The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium (including without limitation, print publications, public broadcast, electronic communications, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. The undersigned waives any right that the undersigned may have to inspect or approve the Released Party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. The undersigned releases the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Likeness.
Terms & Liability – New England Rare Bird Workshop
The agreement below governs the New England Rare Bird Photography Workshop [hereafter referred to as Workshop] activities conducted by Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities.

In order to protect the continuity of the New England Rare Bird Workshop and the information that Barry Spruce Photography, LLC has invested much time and resources in gathering, you agree to not disclose specific location information from the Workshop. A generic description such as “Maine Coast” is permissible.
5. Workshop participants grant Barry Spruce Photography, LLC its agents, employees, licensees, and successors in interest (collectively, the “Released Party”) rights and permission to copyright, use and publish the participant’s photographed likeness obtained during participation in the Workshop. Snowy Owl Workshop participants grant Barry Spruce Photography, LLC its agents, employees, licensees, and successors in interest (collectively, The “Released Party”) rights and permission to copyright, use and publish the participant’s photographed likeness obtained during participation in the Workshop. The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium (including without limitation, print publications, public broadcast, electronic communications, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. The undersigned waives any right that the undersigned may have to inspect or approve the Released party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. The undersigned releases the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Likeness.
Terms & Liability – Private Tours & Photography Lessons
1. Our guided tours and lessons are customized to what you want to do, see, and learn. Therefore, they require communication between you and us so that we can meet your expectations. Please, be prepared to communicate to us before and during the tour and/or lesson. Your feedback is needed and wanted to ensure that we are providing the tour or lesson that you want.
2. Nature and wildlife by definition are unpredictable. We cannot control the weather nor can we control changes in the wildlife’s typical habits. That being said, we can work with you to adjust schedules for days that are total “washouts”. However, in general, we go rain or shine. Rainy conditions can actually provide for a better photography experience. Regarding wildlife, we cannot guarantee that you will see / photograph a particular subject. Wildlife habits can change unexpectedly day by day and hour by hour based on pressures by other animals or by people, or for unknown reasons. However, the more flexible you are the more amazing and beautiful things you will see and capture with your camera.
3. We customize our tours and lessons based on your physical capabilities or limitations. However, this can impact how much we are able to do and see during a tour / lesson.
4. To reserve a particular tour / lesson date, we require a deposit of 1/2 of the tour / lesson fee. The remaining balance is due on or before the scheduled tour / lesson date. A deposit or full payment amount is NOT refundable, because we have set aside this time for you and not booked anyone else. However, we understand that unexpected things happen and that you may need to cancel or reschedule. We will work with you to reschedule your tour or lesson (within a year). You can also apply your balance towards another tour that we offer (within a year).
5. If for some unforeseen reason Barry Spruce Photography, LLC must cancel a scheduled tour / lesson and you are not able or do not wish to reschedule, we will refund the deposit / balance that you have paid.
Each attendee is responsible for all additional costs including, but not limited to, travel, lodging, transportation, and meals. Guided Tour payments are non-refundable; however, in the event that you must cancel, the amount of your Guided Tour payment may be applied to another tour within 1 year.
Risk Statement & Refund Policy – Smoky Mountain Wildflowers Workshop
In consideration of the services of Barry Spruce Photography, LLC their officers, agents, employees, and stockholders, and all other persons or entities associated with those businesses (hereinafter collectively referred to as “Barry Spruce Photography, LLC”) I agree as follows:
Although Barry Spruce Photography, LLC has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, Barry Spruce Photography, LLC has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Barry Spruce Photography, LLC does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks.
– Riding in or operating motorized vehicles
– Severe and / or unpredictable weather conditions including but not limited to extreme cold, extreme heat, rain, snow, sleet, ice, wind
– Uneven, undeveloped, and / or rugged terrain which could result in injuries related to slipping, tripping, falling
– Dangerous and / or poisonous flora, fauna, and insects
– Some activities may occur around water such as creeks, streams, rivers, ponds, lakes which could result in falls and risks of
drowning
– Physical stress – some activities may involve physical exertion such as mild to moderate hiking / walking and I am
responsible for ensuring that I am in sufficient physical condition to participate
I am aware that outdoor guided tours and/or workshops entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks.
I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of Barry Spruce Photography, LLC has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity.
I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.
In order to protect the continuity of the Smoky Mountain Wildflower Workshop and the information that Barry Spruce Photography, LLC has invested much time and resources in gathering, you agree to not disclose specific location information from the workshop. A generic description such as “Smoky Mountain NP” is permissible.
Each attendee is responsible for all additional costs including, but not limited to, lodging, travel to and from the area, meals, snacks, incidentals, and travel insurance. Workshop payments are non-refundable. No refund will be issued if you withdraw from the workshop. Trip/travel insurance is recommended. Barry Spruce Photography, LLC is not responsible for cancellations or workshop schedule changes due to events outside of our control such as local, State, Federal or other governing body shutdowns, travel restrictions/bans, civil unrest, labor disturbances, natural disasters, etc. Refunds will not be issued should such events occur; however, we will work with workshop participants to reschedule to a new date or provide full credit to join another workshop. Barry Spruce Photography is not responsible for reimbursement of any travel expenses or other related expenses in the event of a workshop cancellation or rescheduling. In the unlikely event that Barry Spruce Photography, LLC cancels a workshop for reasons within Barry Spruce Photography, LLC’s control and does not reschedule it, a full refund of the workshop fee will be given. I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children.

Workshop participants grant Barry Spruce Photography, LLC its agents, employees, licensees, and successors in interest (collectively, The “Released Party”) rights and permission to copyright, use and publish the participant’s photographed likeness obtained during participation in the Workshop. The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium (including without limitation, print publications, public broadcast, electronic communications, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. The undersigned waives any right that the undersigned may have to inspect or approve the Released party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. The agreement below governs the Jackson Hole & Grand Tetons Photography Workshop [hereafter refere to as workshop] activities in Jackson Hole, Wyoming and surrounding areas, as applicable, conducted by Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities in Jackson Hole, Wyoming.
By signing your name on this form you hereby release Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities from liability and assume the risks as follows: This liability release is for any and all liability for personal injuries including death and property losses or damage in connection with any activity or accommodation of the above mentioned Barry Spruce Photography, LLC.

The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium (including without limitation, print publications, public broadcast, electronic communications, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. The undersigned waives any right that the undersigned may have to inspect or approve the Released party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. Assumption of Risks and Voluntary Waiver of Liability
Your electronic agreement serves as a legally binding agreement and you hereby release Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities from liability and assume the risks as follows. This liability release is for any and all liability for personal injuries including death and property losses or damage in connection with any activity or accommodation of the above-mentioned Barry Spruce Photography, LLC.
You acknowledge that your participation in this activity is purely voluntary, and you elect to participate in said Workshop in spite of and with full knowledge of the inherent risks including the possibility of personal injury which could be fatal and damage to or loss of personal property including camera equipment. You acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that you have responsibilities as a participant. You certify that you are fully capable of participating in this activity. Therefore, you assume and accept full responsibility for yourself for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers known and unknown and as a result of your negligence in participating in this activity.
On rare occasions accidents or death may occur from participation in outdoor adventures, which necessitates the administration of medical care, hospitalization or surgery. Therefore, you give Barry Spruce Photography, LLC authorized representative(s) or agent(s) in charge of the aforesaid Workshop authorization to secure necessary treatment and transportation. Such treatment and transportation shall be solely at your expense and you agree to reimburse Barry Spruce Photography, LLC any expenses which it may incur from said injury treatment and transportation. You further agree to hold valid personal health insurance policy during the time that you participate in the Workshop.
You understand and agree to indemnify and hold harmless Barry Spruce Photography, LLC and its representative(s) and agent(s) from any and all claims and causes of action for damage arising out of any travel or activity conducted by or under the control of Barry Spruce Photography, LLC with regard to the aforesaid Workshop.
You further understand that you are solely responsible for any and all costs arising out of your voluntary or involuntary withdrawal from the aforesaid Workshop prior to its completion, including withdrawal caused by illness. You are responsible for all additional costs including, but not limited to, travel, lodging, and transportation before and after the Workshop; meals not included in the Workshop; other incidentals; travel/trip insurance.

Barry Spruce Photography, LLC is not responsible for reimbursement of any travel expenses or other related expenses in the event of Workshop cancellation or rescheduling. - In order to protect the continuity of the Workshop and the information that Barry Spruce Photography, LLC has invested much time and resources in gathering, you agree to not disclose specific location information regarding wildlife from the Workshop. A generic description such as “Smoky Mountains NP” is permissible.
- Workshop participants grant Barry Spruce Photography, LLC its agents, employees, licensees, and successors in interest (collectively, the “Released Party”) rights and permission to copyright, use and publish the participant’s photographed likeness obtained during participation in the Workshop. The Likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video works, and in any medium (including without limitation, print publications, public broadcast, electronic communications, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication. The undersigned waives any right that the undersigned may have to inspect or approve the Released Party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness. The undersigned releases the Released Party (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Likeness.

The agreement below governs the Smoky Mountain Fall Colors Workshop [hereafter referred to as Workshop] activities within the Great Smoky Mountains National Park conducted by Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities.
In consideration of the services of Barry Spruce Photography, LLC their officers, agents, employees, and stockholders, and all other persons or entities associated with those businesses (hereinafter collectively referred to as “Barry Spruce Photography, LLC”) I agree as follows:
Although Barry Spruce Photography, LLC has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, Barry Spruce Photography, LLC has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Barry Spruce Photography, LLC does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks.
The following describes some, but not all, of those risks.
- Severe and / or unpredictable weather conditions including but not limited to extreme cold, extreme heat, rain, snow, sleet, ice, wind
- Uneven, undeveloped, and / or rugged terrain which could result in injuries related to slipping, tripping, falling
- Dangerous and / or poisonous flora, fauna, and insects
- Some activities may occur around water such as creeks, streams, rivers, ponds, lakes which could result in falls and risks of drowning
- Physical stress – some activities may involve physical exertion such as mild to moderate hiking / walking and I am responsible for ensuring that I am in sufficient physical condition to participate
I am aware that outdoor guided workshops entail risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified.
My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of Barry Spruce Photography, LLC has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.

The agreement below governs the Smoky Mountain Waterfalls Photography Workshop [hereafter referred to as Workshop] activities that are outside of the boundaries of the GSMNP conducted by Barry Spruce Photography, LLC. By signing your name on this form, you hereby release Barry Spruce Photography, LLC and all associated affiliates, owners, employees, and business entities from liability and assume the risks as follows: This liability release is for any and all liability for personal injuries including death and property losses or damage in connection with any activity or accommodation of the above-mentioned Barry Spruce Photography, LLC.
- On rare occasions accidents or death may occur from participation in outdoor adventures, which necessitates the administration of medical care, hospitalization or surgery. Therefore, you give Barry Spruce Photography, LLC authorized representative(s) or agent(s) in charge of the aforesaid Workshop authorization to secure necessary treatment and transportation. Such treatment and transportation shall be solely at your expense and you agree to reimburse Barry Spruce Photography, LLC any expenses which it may incur from said injury treatment and transportation.
- You understand and agree to indemnify and hold harmless Barry Spruce Photography, LLC and its representative(s) and agent(s) from any and all claims and causes of action for damage arising out of any travel or activity conducted by or under the control of Barry Spruce Photography, LLC with regard to the aforesaid Workshop.
- You further understand that you are solely responsible for any and all costs arising out of your voluntary or involuntary withdrawal from the aforesaid Workshop prior to its completion, including withdrawal caused by illness. Trip/travel insurance is recommended. Each attendee is responsible for all additional costs including, but not limited to, travel, lodging, and transportation before and after the Workshop; meals not included in the Workshop; other incidentals; travel/trip insurance. Workshop payments are non-refundable. No refund will be issued if you withdraw from the Workshop. Trip/travel insurance is recommended.
